This document describes the terms of use applicable to the use of the Accor portal accessible on https://developer.accor.com (the “Portal”) (the “Portal Terms of Use”). The Portal enables the access to application programming interfaces (the “APIs”).
These Portal Terms of Use are binding between you as a user (“You”) and Accor (registered at the Nanterre RCS under the number 602 036 444) (“Accor”), hereinafter together referred to as the “Parties” or individually as a “Party”.
Your access to and use of the Portal are subject to Your acceptance and compliance with these Portal Terms of Use.
If You use the Portal on behalf of a legal entity, You represent that You have the authority and have obtained all necessary consents to bind such entity to these Portal Terms of Use and that You accept these Portal Terms of Use on behalf of such entity. All references to “You” mean, as applicable and depending on the context, You or such entity.
By using the Portal, You accept these Portal Terms of Use without reservation. Accor may make changes to the Portal Terms of Use and any related documents, at its own discretion, and without notice. You are advised to consult these Portal Terms of Use regularly for any changes. In the event that the changes materially alter the Portal, Accor will make reasonable efforts to notify You of such change. Your continued use of the Portal indicates that You have read, understood and agreed to the current version of these Portal Terms of Use.
You undertake to use the Portal for professional purposes, and thus not to use the Portal as an individual consumer. If You are not using the Portal for professional purposes, You must not use the Portal.
1. Creation, management and deletion of a developer account
1.1 Creation of a developer account
In order to access the Portal, You must:
- Create a developer account on the Portal through this link: https://developer.accor.com/user/register.
- Activate Your account by following the link received by email.
You must ensure that the information You provide to Accor is accurate and up to date.
The creation of an account implies that You provide personal information such as first name, last name, name of Your company and email address, which are subject to data processing as provided in Section 6.2 hereto.
In the event that You provide false, inaccurate, outdated, incomplete, misleading or deceptive information, Accor may, immediately and without notice or compensation, suspend or terminate Your account and refuse access, temporarily or permanently, to all or part of the Portal.
1.2 Management of Your account
You may request a password reset by clicking on “Reset your password” (available at: https://developer.accor.com/user/password or on the “Edit “tab” available in Your account parameters). Password reset instructions will then be sent to Your registered email address.
As long as Your account is active, You may update Your personal information or Your company information at any time.
1.3 Deletion of Your account
You may at any time delete Your account by accessing Your profile: “My profile > Edit > Cancel”.
2. Access to the Portal
2.1 Access rights
You can access and use the Portal free of charge.
Your access to the Portal is personal and confidential. You are responsible for maintaining appropriate security (including technical and organizational measures) to keep Your credentials confidential. You must not enable any unauthorized third party to access the Portal, including by use of Your credentials. You must not sublicense Your access to, or Your use of, the Portal. Any loss, misappropriation or unauthorized use of an account and their consequences are Your sole liability. In all the cases abovementioned, You are required to inform us, without delay, by email, so that Accor can proceed to reinitialize the account.
In the event that You breach the aforementioned obligations, Accor may, immediately and without notice or compensation, suspend or terminate Your account and refuse access, temporarily or permanently, to all or part of the Portal.
2.2 Availability
Accor will use commercially reasonable efforts to make the Portal available 24 hours a day, 7 days a week.
Notwithstanding the above, Accor reserves the right to interrupt access to and use of all or part of the Portal at any time, with or without notice, in particular in order to ensure the security of the Portal and for the purposes of corrective and evolutionary maintenance of the Portal, or to improve its content or presentation. Accor will, to the extent possible, notify You in advance of any corrective or upgrading maintenance.
Furthermore, Accor will not be liable for failure to provide access to the Portal due to any emergency maintenance, any catastrophic system failure at Accor, any failures of Customer's equipment or systems including internet network failure, or due to acts outside the control of Accor. You are informed of the risks inherent in the use of the Internet, in particular in terms of security defects in the transmission of data and of non-guaranteed availability of access to the Portal.
Accor disclaims any and all liability for any inconvenience, loss or damage in connection with the use of the internet, in particular but without restriction, poor transmission and/or receipt of any data and/or information over the internet, the failure of any receiving equipment or lines of communication, any malfunction of the internet preventing the proper operation of the Portal and, more generally, any loss or damage arising out of the use of the Portal, the internet and information and telecommunication systems. Neither Accor nor its directors or employees shall be liable for any loss or damage, howsoever caused, arising out of a use of the Portal, for which You are solely responsible. It is up to You to take all appropriate measures to ensure the security of Your equipment, data, software or other property, in particular against infection by any virus and/or attempted intrusion of which You might be the victim.
3. Intellectual property rights
All intellectual property rights relating to the Portal and its contents (API, API Data, trademarks, logos, signs texts, images, videos, sound, etc.) are and remain the property of Accor, or are subject to licenses and/or authorizations granted to Accor by third-parties. You agree to respect the intellectual property rights of Accor and the rights of third parties.
You are only permitted to use the Portal and its content in accordance with these Portal Terms of Use and, where applicable, the APIs terms of service.
You may not reproduce, make available to the public, perform, publish or modify any part of the Portal and its content without the prior written authorization of the Accor or, for the APIs, as permitted in the APIs terms of service.
Any total or partial representation of these elements, by any means whatsoever, without the express authorization of Accor would constitute an infringement punishable by Article L.335-2 and the following of the Intellectual Property Code.
The Portal may contain links to other websites or external sources (“Third-Party Sites”). To the extent that Accor has no control over such Third-Party Sites or their content, Accor can provide no assurances concerning their availability or content and disclaims any liability in connection with the content, ads, products, services or other materials available on or from such Third-Party Sites. By providing links to such Third-Party Sites, Accor does not approve, endorse, or make any representation concerning the content of such Third-Party Sites, nor does any such link indicate any association between Accor and the owners and/or authors, designers, managers, administrators or hosts of such Third-Party Sites. These links are provided for information purposes only and You acknowledge that You are solely responsible for any decision by You to activate the links to such Third-Party Sites. Accor also disclaims any and all liability for any actual or alleged damages or losses arising out of or in connection with Your use, or reliance on the content, goods or services available on such Third-Party Sites.
4. Your obligations
You are responsible for Your use of the Portal. In particular, You are responsible for maintaining appropriate security to keep Your credentials confidential as provided in Article 2.1 above.
Accor supports and promotes the values of tolerance, diversity and respect for others.
You undertake to respect these values when using the Portal. In particular, You undertake:
- not to make any discriminatory, racist, xenophobic, anti-Semitic, insulting, malicious, obscene, illicit or other violent or pornographic comments, nor to publish any content contrary to public order or morality in any way whatsoever while browsing and using the Portal;
- not to publish any content that may be harmful, defamatory, unauthorised, malicious or infringing on privacy or publicity rights, inciting violence, racial or ethnic hatred or which may be described as gross indecency or incitement to commit certain crimes or offences;
- not to impersonate any person or entity or misrepresent Your affiliation with another person or entity;
- not to use the Portal for political, propaganda or proselytizing purposes;
- not to infringe Accor's intellectual property rights on the Portal and its contents;
- not to spam, intimidate, solicit or otherwise misuse the Portal;
- not to carry out illegal activities, by publishing content (photographs, images, texts, videos) involving minors in any way whatsoever;
- to notify Accor of any inappropriate content.
5. Accor’s liability
You expressly understand and agree that Your use of the Portal is at Your sole risk and that the Portal is provided “as is” and “as available” by Accor.
Accor does not provide any warranty of any kind, including with regard to the accuracy, usefulness, or fitness for purpose of the Portal or the APIs, nor with regard to the availability or uninterrupted use of the Portal.
The limitations stipulated herein apply to the maximum extent permitted under applicable law and You expressly acknowledge that Accor cannot be held liable in any way for:
- suspension of access to the Portal for maintenance purposes;
- reduced performance or temporary or permanent unavailability of the Portal;
- interruption of the Portal;
- damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Portal;
- the occurrence of any damage resulting from Your fault, misuse of the Portal or negligence;
- and more generally for the inability to access the Portal, Internet network mal-functions, defects, viruses or the credit given to any information coming directly or in-directly from the Portal.
6. Personal Data
6.1. Your processing of Personal Data
You represent and warrant that You will comply with any and all applicable laws and regulations (including but not limited to the E.U. General Data Protection Regulation “GDPR”) pertaining to the protection and use of “Personal Data”, defined as any information relating to an identified or identifiable natural person, and more generally, to take all the necessary steps with the relevant authorities pursuant to the provisions of local law and, as from its entry into force, to comply with all provisions incumbent upon it under the GDPR.
6.2. Accor’s processing of Your Personal Data
For access and use of the Portal, notably the creation of Your account, Accor may process Your Personal Data, as further described below:
Your information is processed by Accor SA for the purpose of accessing the Portal and managing Your account. This data processing is necessary to enable us to perform the contract to which You subscribe, and Your data is intended for authorized personnel in charge of managing the APIs and technical subcontractors (processors of personal data).
Unless otherwise provided by law or regulation, Your data will be kept for the duration of existence of Your account to access the Portal.
To exercise Your rights (access to, rectification, erasure of personal data, restriction or objection to processing, data portability, definition of guidelines for processing Your data after your death), please write to accor.openapi.support@accor.com.
Your data may be transferred to countries outside the European Union. If such countries are not recognized as ensuring an adequate level of data protection, appropriate and adapted guarantees have been implemented to supervise this transfer. You can request a copy at the above address.
You may also contact Accor Data Protection Officer by writing to accorhotels.dpo@accor.com or lodge a complaint with a supervisory authority.
The use of the Portal requires the use of functional cookies.
7. Governing law and jurisdiction
These Portal Terms of Use and any disputes or claims arising out of or in connection with them are governed by and construed in accordance with the laws of France, without reference to rules governing choice of laws or without giving effect to any choice of law or conflicts of laws rules or provisions that would cause the application of the laws of any other jurisdiction.
IN CASE OF ANY COMPLAINT OR DISPUTE ARISING OUT OF OR IN CONNECTION WITH THE APPLICATION, INTERPRETATION OR PERFORMANCE OF THIS PORTAL TERMS OF USE, YOU AND ACCOR SHALL ENDEAVOUR TO FIND AN AMICABLE SOLUTION. FAILING AMICABLE RESOLUTION, YOU CONSENT TO AND WAIVE ANY OBJECTION TO THE EXCLUSIVE JURISDICTION AND THE COMMERCIAL COURT OF PARIS WITH RESPECT TO ANY CLAIMS, SUITS OR PROCEEDINGS.
8. General provisions
8.1 A waiver by Accor of any of its rights under these Portal Terms of Use must, in order to be valid, be made in writing.
8.2 If any stipulation(s) of these Portal Terms of Use or the application thereof shall be invalid or unenforceable to any extent, the remainder of these Portal Terms of Use and the application of such stipulations shall not be affected thereby and shall be enforced to the greatest extent permitted by law.
8.3 Any notices required or made pursuant to these Portal Terms of Use must be in writing. Accor may notify You directly on the Portal. Any notice, information or complaint made by You under these Portal Terms of Use, to Accor, must be sent through the Portal or at accor.openapi.support@accor.com.
8.4 You may not assign, delegate or subcontract any of Your rights or obligations under these Portal Terms of Use without the prior written consent of Accor.
